These Terms and Conditions govern your use of www.saayer.com (the "Website", "Platform", or "Saayer Application"), operated and owned by Saayer Information Technology Solutions Establishment, duly registered in accordance with the applicable laws and regulations of the Kingdom of Saudi Arabia.
By accessing, browsing, or using the Platform, whether in your personal capacity or on behalf of a company you represent, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions and all related usage policies. If you do not agree to these Terms and Conditions, you must immediately refrain from registering, accessing, or using the Website, the Platform, or the Application.
We reserve the right to amend or update these Terms and Conditions and the Privacy Policy at any time. Any amendments shall become effective immediately upon publication on the Platform. Your continued use of the Platform following such amendments constitutes your acceptance thereof. You are responsible for reviewing these Terms and Conditions periodically.
1. Intellectual Property Rights
- All intellectual property rights relating to the content available on the Saayer Platform and Application are owned by Saayer and are protected under applicable copyright, trademark, and intellectual property laws
- You may not modify, copy, reproduce, distribute, display, create derivative works from, or exploit any content without prior written consent
- All trademarks and logos are the exclusive property of Saayer
- The use of robots, scraping tools, or data extraction methods to access the Platform is prohibited
2. Service Providers
- Saayer is not a carrier or shipping company. Saayer operates solely as a digital platform that facilitates access to discounted shipping services
- Saayer shall not be responsible for any errors, omissions, delays, or actions committed by shipping companies or their employees
- Prior to issuing any shipment waybill, the customer is advised to review and understand the terms and conditions of the selected shipping company
3. Restrictions on Use for Commercial Users and Freelancers
- Services are limited to merchants, companies, and freelancers who are legally registered and duly licensed
- Users must provide a valid commercial registration or an active freelance license for eligibility verification
- Use of the Platform for personal purposes or for activities unrelated to the registered business is strictly prohibited
- Reselling the service, including issuing shipment waybills on behalf of unrelated third parties, is prohibited
4. Registration on the Saayer Platform
- You agree to provide accurate, complete, and up-to-date personal information
- Saayer reserves the right to suspend or terminate services and accounts in the event of breach
- Saayer may disclose user data to security or judicial authorities upon official request
- You are solely responsible for maintaining the confidentiality of your login credentials
5. Cancellation and Refunds
- Customer has the right to cancel a shipment waybill prior to handover to the shipping company, within a maximum period of five (5) days from the date of issuance
- Customer may cancel a shipment and request a refund provided the shipment has not been handed over to the carrier
- Shipping companies do not accept refunds once a shipment waybill has been received and processed
- Shipping companies may allow the issuance of a new waybill subject to payment of new fees
6. Shipment Restrictions and Liability
- You warrant that shipments do not contain anything unsafe, illegal, or prohibited (e.g., drugs, flammable materials, currency, precious metals, credit cards, SIM cards)
- If any shipment violates restrictions, you agree to defend, indemnify, and hold harmless the shipping company and Saayer
- Saayer does not inspect, receive, package, or handle shipments
- You remain solely responsible for your shipments and their contents
- Saayer shall not be liable for any indirect, incidental, special, or consequential damages
7. Shipment Weight
- Shipping charges are calculated based on the greater of actual weight or volumetric weight
- Volumetric weight = (Length × Width × Height) ÷ 5000 (international) or 4000 (domestic)
- You must accurately declare the actual weight and dimensions
- The carrier reserves the right to re-weigh shipments and apply charges based on the higher weight
- Any discrepancies shall result in additional charges payable by the customer
8. International Shipping
- Customer shall be responsible for paying all applicable customs duties, taxes, fees, or commissions prior to shipment release
- If the carrier pays such amounts on behalf of the customer, the customer must reimburse immediately
- This clause also applies to returned shipments for any reason
9. Shipment Pickup and Delivery
- Pickup times are subject to carrier schedules and terms
- Some carriers may require a minimum number of shipments or impose additional pickup fees
- By providing sender and recipient information, you consent to the carrier's use and sharing of such data
- Once a waybill is issued and handed over, Saayer shall not be responsible for any costs arising from customer-requested changes
- Customer is solely responsible for proper packaging
10. Abandoned, Unclaimed, or Returned Shipments
Policies regarding abandoned, unclaimed, or returned shipments vary by carrier. Please review the specific carrier's terms and conditions.
11. Fees and Pricing
- Registration on the Saayer Platform is free of charge
- Saayer may introduce subscription fees or service packages in the future
- Saayer charges service fees for issuing shipment waybills, which vary depending on the selected carrier
- Saayer reserves the right to amend, increase, decrease, or discount fees at its sole discretion
- Saayer may issue or discontinue promotional offers or discount codes at any time
Language
The Arabic version of this Agreement shall prevail and shall be the governing text in case of any discrepancy.
Liability and Indemnification
The customer acknowledges and agrees that any breach of these Terms shall be their sole responsibility. The customer agrees to indemnify Saayer, its affiliated shipping companies, officers, directors, employees, and agents against any claims, losses, damages, costs, or legal fees arising from misuse or breach of the service.
Dispute Resolution
Any dispute arising from the interpretation or implementation of this Agreement shall be resolved amicably where possible. Failing such resolution, disputes shall be referred to the competent courts of the Kingdom of Saudi Arabia in accordance with applicable laws.
